What Happened? | क्या हुआ है?
A meeting was held on 2 July 2026 in the Ministry of Finance under the chairmanship of the Secretary, Department of Expenditure. In this meeting, the JCM Staff Side discussed the hardship faced by serving, retiring and retired Central Government employees when departments start recovering amounts that were paid to them in excess — often due to no fault of the employee.
2 जुलाई 2026 को वित्त मंत्रालय में सचिव (व्यय विभाग) की अध्यक्षता में बैठक हुई। इसमें JCM स्टाफ साइड ने बताया कि कई कर्मचारियों और पेंशनभोगियों को बिना उनकी गलती के हुए अधिक भुगतान की वसूली के कारण भारी आर्थिक परेशानी झेलनी पड़ रही है।

Key Demands of JCM Staff Side | प्रमुख मांगें
1. Strict Implementation of DoPT OM 02.03.2016
All Ministries, Departments and subordinate offices must strictly follow the DoPT OM dated 02.03.2016, which protects certain categories of employees from recovery. The Staff Side also suggested that non-compliance should attract action against the responsible officers.
सभी मंत्रालयों और विभागों में DoPT के 02.03.2016 के आदेश का सख्ती से पालन हो। पालन न करने पर जिम्मेदार अधिकारियों पर कार्रवाई की जाए।
2. Waiver Powers up to ₹5 Lakh to Head of Department
In cases covered under the five protected categories of the DoPT OM, the Head of the Department (HoD) should be given the power to waive recovery up to ₹5 lakh. This will remove unnecessary delays in genuine cases.
₹5 लाख तक की वसूली माफ करने का अधिकार विभागाध्यक्ष (HoD) को दिया जाए, ताकि मामलों का निपटारा जल्दी हो।
3. Waiver Powers of ₹5–10 Lakh to the Ministry/Department
Recovery cases between ₹5 lakh and ₹10 lakh should be decided at the level of the concerned Ministry or Department itself.
₹5 लाख से ₹10 लाख तक के मामलों में माफी का निर्णय संबंधित मंत्रालय/विभाग के स्तर पर हो।
4. Cases Above ₹10 Lakh to Department of Expenditure
Only cases where the recovery amount exceeds ₹10 lakh should be referred to the Department of Expenditure for a decision.
केवल ₹10 लाख से अधिक की वसूली वाले मामले ही व्यय विभाग को भेजे जाएं।
5. Immediate Intimation and Automatic Waiver Process
Whenever an excess payment is detected and the case falls under the protected categories of the DoPT OM, the employee should be informed immediately and the waiver process should start without delay — instead of first issuing recovery orders.
यदि मामला DoPT आदेश की संरक्षित श्रेणियों में आता है, तो कर्मचारी को तुरंत सूचित किया जाए और बिना देरी के माफी की प्रक्रिया शुरू की जाए।
Why Does This Matter for Postal Employees? | डाक कर्मचारियों के लिए क्यों महत्वपूर्ण?
Excess payment recovery cases are quite common in India Post — for example, wrong pay fixation after promotion or MACP, incorrect increment, wrong allowance drawal, or errors at the time of retirement. In many such cases the employee is not at fault, yet recovery orders cause severe financial stress, especially for retiring officials whose gratuity or leave encashment gets held up.
डाक विभाग में प्रमोशन/MACP के बाद गलत वेतन निर्धारण, गलत वेतन वृद्धि या भत्ते के कारण अधिक भुगतान के मामले आम हैं। इनमें अधिकतर बार कर्मचारी की कोई गलती नहीं होती, फिर भी वसूली के आदेश से — विशेषकर सेवानिवृत्ति के समय — भारी परेशानी होती है। यदि ये मांगें मान ली जाती हैं, तो लाखों कर्मचारियों को राहत मिलेगी।

Based on the Supreme Court ruling, the DoPT OM of 02.03.2016 lists categories of employees from whom recovery of excess payment is generally impermissible — such as Group C/D (now equivalent lower-level) employees, retired employees or those close to retirement, and cases where recovery is sought after a long period or would be iniquitous or harsh. The current JCM demand is essentially about implementing this protection quickly and uniformly across all departments.
