Background — What Led to This Order
- AIPEU Group ‘C’ is an association de-recognized under the provisions of the CCS (RSA) Rules, 1993.
- It filed W.P. No. 3395 of 2023 before the Hon’ble High Court of Jharkhand.
- The plea sought the grant of limited trade union facilities of the kind already extended to the Bharatiya Postal Employees Federation (BPEF) and its affiliated Associations.
- By judgment dated 06.12.2025, the High Court directed the Department to extend similar treatment to AIPEU Group ‘C’ as extended to BPEF and its affiliates.
- In compliance, and with the approval of the competent authority, the Department has now extended these facilities.
The Five Facilities Granted to AIPEU Group ‘C’
The following limited Trade Union facilities — the same as extended to BPEF, its affiliated Associations and non-recognized Associations — are hereby extended:
- (i) Channel of communication
- (ii) Meeting with senior officers, namely Circle, Regional and Divisional Heads
- (iii) Office accommodation, subject to availability
- (iv) Special Casual Leave of 10 days to 7 of its office bearers at Circle, Regional and Divisional level, to attend All India Conference / Executive Committee meetings and union seminars with senior officers, as and when called for
- (v) Immunity in transfer to 2 of its Office Bearers at Circle, Regional and Divisional level from Head Quarter

Two Very Important Conditions
These two paragraphs are the heart of the order. Read them carefully.
1. The facilities are temporary and conditional
The above Trade Union facilities shall remain in force:
- Till completion of the membership verification process, and
- Subject to the outcome of LPA No. 436 of 2026 filed before the Division Bench of the Hon’ble High Court of Jharkhand, challenging the judgment dated 06.12.2025 in W.P. No. 3395 of 2023,
- whichever is earlier.
2. This is NOT recognition
The grant of these limited facilities shall not be construed as recognition or restoration of recognition of AIPEU Group ‘C’.
- The de-recognized status of the Association continues.
- It shall continue to be governed by the applicable provisions of the CCS (RSA) Rules, 1993 and orders/instructions issued by the Department from time to time.
In plain words: The union gets working facilities because of a court order, but it does not get back its recognized status.
